7. The Main Purpose. Payola is mainly about power. A visible demonstration that a government agency can operate outside the law, with impunity. The FCC can reinstate and sustain it's own version of Mccarthyism, with no criticism from the courts, broadcast industry, or congress. ...
Q. Who and what is Elliot Spitzer?
A. Spitzer is lost and not connected with the FCC. Elliot Spitzer is New York state's current Attorney General. He has successfully prosecuted broadcast people, although states have no jurisdiction in broadcast matters, as per Communications Act since 1934. So far, the FCC and Spitzer behave as two snapping turtles, who just avoid each other. No published word as to the whereabouts of the Spitzer collected fines. Spitzer need not be att'y general or future governor, etc.
Q. Without criminalisation, what is Payola?
A. A completely legitimate business practice for promoting recordings.
Q. What about income tax issues?
A. The Treasury/IRS has never been in the picture. How can you risk disclosing legitimate income, when your career is wrongfully endangered. Also, some of the Payola charges were just pinned on the victims. Actual fact was never the issue. ..end. PK clear
